DMCA Policy

1. Introduction

Z&Z Auto Sales ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects users of our website, zz-auto-sales.com (the "Site"), to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to valid notices of alleged copyright infringement that comply with the requirements set out below.

This policy outlines the procedure for submitting copyright infringement notifications to us and for submitting counter-notifications if you believe content was removed or disabled in error.

2. Filing a DMCA Takedown Notice

If you believe that content appearing on the Site infringes a copyright you own or control, you (or your authorized agent) may submit a written notification to our Designated Agent identified below. Your notice must be a written communication that includes substantially the following information, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works;
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material on the Site (e.g., a specific URL);
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Notices that do not comply with the requirements above may not receive a response. We strongly recommend consulting the full text of 17 U.S.C. § 512 or seeking legal advice before submitting a notice.

4. Counter-Notification

If you believe that content you posted or that belongs to you was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent that includes substantially the following:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or disabled and the location at which it appeared before it was removed or disabled;
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which the Company may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we may, at our discretion, restore the removed material within 10–14 business days unless the original complaining party notifies us that it has filed a court action seeking a restraining order against the content provider.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances, access for users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site and/or terminate accounts of any users who infringe the intellectual property rights of others, whether or not there is repeat infringement.

6. Misrepresentation

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability. Please carefully consider all facts and circumstances before submitting a DMCA notice or counter-notification.
